What’s the Problem?
April 5, 2017 – The suit, filed last month in Alameda County Superior Court, seeks compensatory and punitive damages from Monsanto and Wilbur Ellis Company, LLC., for wrongful death and personal injuries.
Plaintiffs allege that Monsanto “repeatedly proclaimed and continues to proclaim to the world, and particularly to United States consumers, that glyphosate-based herbicides, including Roundup, create no unreasonable risks to human health or to the environment.”
The lawsuit is one of more than 700 similar complaints filed against Monsanto alleging cancer and other serious injuries from Roundup. In October 2016, a panel of judges consolidated all federal Roundup lawsuits into a multidistrict litigation (MDL No. 2741) for pretrial handling in the Northern District of California.
Last month, a federal judge in San Francisco unsealed documents which suggested that Monsanto employees had ghostwritten studies that the U.S. Environmental Protection Agency (EPA) used to determine glyphosate is not a carcinogen (cancer-causing substance). The documents also found that a former EPA executive worked with the company to suppress reviews of the chemical.
The new lawsuit alleges that plaintiffs suffered “non-Hodgkin’s lymphoma and other cancers, other permanent defects and permanent bodily impairments” which required hospitalization, medication, surgeries and other treatments. The suit claims that Monsanto failed to adequately warn of the health risks of Roundup before bringing the herbicide to market.
